THE HIRER/S AGREE/S AND ACKNOWLEDGES AS FOLLOWS:
The Hirer/s has/have sufficient skills to use the craft and equipment hired.
The Hirer/s can swim.
The Hirer/s will stay within the designated areas as instructed by staff.
The Hirer/s will at all times wear life jackets provided.
The Hirer/s will remain seated at all times.
The Hirer/s will return the craft and equipment to the designated area at the end of the hire period.
If the Hirer/s uses the craft dangerously or is deemed not to be in control of the craft, the Hirer/s will be terminated immediately and no refund will be made.
The Hirer/s will pay any damage caused to the craft and equipment
That they have closely examined the craft and equipment and are satisfied that it is suitable for use in its present condition and state of repair.
That they are liable to identify YellowFin Tours for any loss of or damage to the craft and equipment howsoever caused that occurs as a result of use of the craft and equipment.
That they must as and when required by the proprietor or any employee of YellowFin Tours return the craft and equipment to such person and place as shall be directed
RELEASE AND ACKNOWLEDGEMENT OF RISK:
Accept all the inherent risks of the use of the craft and equipment and the possibility of personal injury, death, property damage or loss resulting therefrom or from any defect (patent or latent) in the craft and equipment.
To the extent permitted by law, hereby waive any and all claims I/we, my/our heirs, next of kin, executors, administrators or successors may now and in the future have against, and release from all liability and agree not to sue YellowFin Tours and its agent/s for any personal injury, death, property damage or loss sustained by me/us.
The hazard of injuries resulting from sea kayak fishing is associated with multiple risks. Some risks, such as the failure of equipment and operating in unsuitable conditions, can be controlled by the provider. Other risks associated with participant error while operating at considerable speed are intrinsic to the activity and cannot be controlled by the provider. The participant has a higher risk of injury and/or death than they would experience in their daily life. Hazards you may be exposed to include sun, deep water, seas and swell, fishing hooks, risk from physical tasks, sea life.
I do not have a medical condition that may impact on my ability to participate safely.
I am not under the influence of drugs/alcohol.
